    How Many Years Can You File Back Taxes in Canada?

    There is no statutory limit on how far back you can file. The CRA accepts T1 returns for any prior year. NETFILE accepts electronic returns for the current and prior 10 years only. Returns older than 10 years must be mailed to the CRA on paper.

    Any refunds you are owed and any missed benefits are only released once the return is filed. This is why filing old years is often worth doing even if it feels unnecessary.

    What Are the Penalties for Filing Back Taxes Late?

    If you owe money and filed late, you pay 5% of the balance owing plus 1% per month for up to 12 months. If you had a previous late filing in the prior 3 years, this doubles to 10% plus 2% per month up to 20 months.

    If you do not owe money, there is no financial penalty. Your only cost is your withheld refund and missed benefit payments, which are released once you file.

    What Is the CRA Voluntary Disclosures Program?

    The VDP allows taxpayers to come forward and correct prior tax omissions or errors before the CRA contacts them. If accepted, the CRA may waive all or part of the penalties that would otherwise apply. Interest on unpaid tax is generally not waived.

    You must apply before the CRA has started any audit or enforcement action on the same issue. There are two tracks: a general program for most disclosures, and a limited program for major disclosures.

    Coming forward to file back taxes before the CRA contacts you puts you in control. Waiting for the CRA to contact you first removes your access to the Voluntary Disclosures Program and all the penalty relief that comes with it.

    What Documents Do You Need to File Prior Year Tax Returns?

    You need the same documents as a current year return T4s, T5s, RRSP receipts, and other income documentation for each year. CRA My Account shows all T-slips received from third parties for the past 10 years.

    Former employers can provide old T4s. For years where documentation is unavailable, the CRA may accept reconstructed records.

    Can You File Multiple Years of Back Taxes at Once?
