Website vs Application

This Privacy Policy applies to both (a) our marketing website and (b) our web-based application platform. The type of personal information collected depends on how you interact with us:

Website: We collect limited information through contact forms, pre-registration forms, careers submissions, and cookies/analytics tools.

Application: We collect personal information and sensitive personal information necessary to provide tax preparation, consultation, audit support, identity verification, and electronic filing services, including SIN, financial information, and government-issued identification.

INFORMATION WE COLLECT ABOUT YOU

We collect and use several types of information from and about you, including:

  • Personal information, that we can reasonably use to directly or indirectly identify you, such as your name, mailing address, e-mail address, telephone number, Internet protocol (IP) address used to connect your computer to the Internet, user name or other similar identifier, account registration information, consultation or service-related information, Social Insurance Number (SIN), tax and financial information, copies of government-issued identification, facial verification images and any other identifier we may use to contact you (“personal information“). Where required by law, we obtain express consent for the collection, use, or disclosure of sensitive personal information.

Certain categories of personal information we collect, including identification numbers, tax and financial information, and government-issued identification, are considered sensitive personal information under applicable Canadian privacy laws. Such information is collected only in connection with the services requested by you and in accordance with applicable legal requirements.

  • Information collected through the Website, including information you voluntarily provide when completing contact forms, pre-registration forms, or career applications, such as your name, email address, phone number, message content, cover letter, and resume.
  • Information collected through the Application, including information you provide when creating an account, completing questionnaires, uploading documents, booking consultations, submitting tax-related information, or otherwise interacting with features of the Application.
    • Non-personal information, that does not directly or indirectly reveal your identity or directly relate to an identifiable individual, such as  demographic information, or statistical or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal information. For example, we may aggregate personal information to calculate the percentage of users accessing a specific Website feature.  
    • Technical information, including your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access our Website or Application, and usage details.

  • Information and documentation you voluntarily upload or submit, including tax-related information, government-issued identification, facial verification images, and other information necessary to provide the services you request.

  • Details of transactions you carry out through our Website or Application and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website. 
  • Information you provide when reporting a problem, requesting support, or otherwise communicating with us regarding the Website or Application.
  • Any other information you choose to provide to us in connection with your use of the Website or Application or the services requested by you.

You may also provide information to be published or displayed (hereinafter, “posted“) on public areas of the Website or transmitted to other users of the Website or third parties or Application (collectively, “User Contributions“). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages/you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. For greater certainty, the Website and Application are not intended to function as public forums, and User Contributions are generally submitted for service-related, administrative, or support purposes rather than for public display. Access to User Contributions is restricted to authorized personnel and service providers acting on our behalf, subject to applicable confidentiality and security safeguards.

We do not use web beacons for third-party behavioural advertising purposes.

We may use third-party service providers to support the operation, hosting, analytics, and functionality of the Website and Application.   • To improve our Website, and Application, products and services, system performance, security, and user experience.
  • To facilitate the review, preparation, verification, and submission of tax filings or related documentation through authorized personnel and service providers acting on our behalf.
  • To communicate with you regarding service-related matters, including confirmations, updates, technical notices, and customer support responses.
  • In any other way, we may describe when you provide the information.

TAX FILING PROVIDERS / PROFESSIONALS

We may share personal information with accountants, CPAs, contractors, and authorized electronic filing service providers involved in preparing, reviewing, verifying, and submitting tax returns.

KEY SERVICE PROVIDERS

The Company may use third party service providers to support hosting, storage, communications, analytics, and security. A current list of key service providers may be made available upon request at [email protected] or by a published list on the Website, and may change from time to time.

DISCLOSURE OF YOUR INFORMATION

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect, or you provide as described in this privacy policy:

  • To our affiliates and related entities, where necessary to support the delivery of services requested by you, and subject to appropriate confidentiality and data protection safeguards.
  • In accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of The Urban Accountant Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by The Urban Accountant Inc. about our customers and users is among the assets transferred.
  • To contractors, professional advisors, accountants, administrative personnel, cloud hosting providers (including Canadian-based hosting providers), and other service providers engaged to support the operation of the Website and Application and to deliver tax preparation, consultation, identity verification, filing, compliance, and related services on our behalf. Such parties are contractually required to protect personal information, use it only for authorized purposes, and comply with applicable privacy laws.
  • We do not sell, rent, or trade your personal information to third parties.
  • To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our Website or Application, we will transmit the contents of that email and your email address to the recipients.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government, tax or regulatory request, in accordance with applicable law.
  • To enforce or apply our Website Terms of Use and End-User License Agreement (EULA) and other agreements, including for billing, service administration, and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of The Urban Accountant Inc., our customers, users, service providers, or others, including for fraud prevention, security monitoring, or risk mitigation purposes

We may disclose personal information to third-party service providers that assist us in operating the Website and Application, including hosting providers, database/storage providers, communications providers (email/SMS/phone), analytics providers, and security providers. These service providers are authorized to access personal information only to perform services on our behalf and are contractually required to protect personal information. We may use third-party communications providers such as Twilio to deliver verification messages, appointment reminders, and service-related notifications.

PAYMENT PROCESSING

Payment information may be processed by third-party payment processors. We do not store full credit card information.

AFFILIATES AND SERVICE PROVIDERS MAY CHANGE

In order to operate the Website and Application and deliver services requested by you (including tax preparation, consultation services, audit support, identity verification, and electronic filing services), we may engage affiliated entities, independent contractors, accountants, CPAs, administrative personnel, and third-party service providers. Such parties may change from time to time. We require all such parties to maintain appropriate confidentiality and security safeguards and to use personal information only for authorized purposes.

MARKETING CONSENT

If you voluntarily provide photos, videos, testimonials, or other media content, we may use such content for marketing purposes only where you provide express consent. Such content may be posted on social media platforms and may be accessible outside of Canada. You may withdraw consent, subject to practical limitations where content has already been publicly distributed.

TRANSFERRING YOUR PERSONAL INFORMATION

We may transfer personal information that we collect or that you provide as described in this policy to contractors, service providers, and other third parties we use to support our business (including cloud hosting providers and technical infrastructure providers supporting the Website and Application) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy.

We store and process personal information in Canada. We do not routinely transfer personal information outside of Canada. If, in the future, personal information is transferred outside of Canada, we will ensure that such transfers comply with applicable Canadian privacy laws and that appropriate contractual and security safeguards are in place. We use Amazon Web Services (AWS) to host and store data. Data is hosted in Canada.

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of the Website or Application may not function properly.   • Withdrawal of Consent. Subject to legal and contractual restrictions, you may withdraw your consent to our collection, use, or disclosure of your personal information at any time by contacting us. Please note that withdrawing consent may limit our ability to provide certain services to you, including tax preparation, consultation, or account functionality.
  • Service Communications. We may send service-related communications (such as account notifications, confirmations, or compliance updates). These communications are necessary to provide our services and are not promotional in nature. 

DATA SECURITY

The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We implement appropriate physical, technical, and administrative safeguards designed to protect personal information against loss, theft, unauthorized access, disclosure, copying, use, or modification. These safeguards include secure hosting within Canada, encryption of sensitive data in transit and at rest, access controls, authentication protocols, and restricted internal access on a need-to-know basis. 

Given the sensitive nature of certain information collected through the Application, including identification numbers and tax-related information, we apply enhanced security controls and limit access to authorized personnel and service providers who require access to perform their duties.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website or Application. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or Application. 

DATA RETENTION

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, tax, accounting, or reporting requirements. 

In particular, where personal information relates to tax preparation, filing, or related services, we may retain such information for up to seven (7) years, or such longer period as may be required under applicable tax or regulatory laws, including record-keeping requirements.

Under some circumstances, we may anonymize or de-identify your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent, provided that such data does not identify you as an individual.

When personal information is no longer required for the purposes for which it was collected and is not required to be retained by law, we will securely delete, destroy, or anonymize it in accordance with our internal data retention and disposal practices. 

CHILDREN UNDER THE AGE OF 13

Our Website or Application is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Website or the Application. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Website or Application or on or through any of its features/register on the Website, or the Application, or make any purchases through the Website or Application, use any of the interactive or public comment features of this Website or Application, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If access is refused, we will provide reasons, subject to legal or regulatory restrictions.

  • Information that is part of a formal dispute resolution process.
